# terms of use

these terms apply to (1) the chonkyapp mobile app (the “app”) and (2) the hexeosis.com website (the “site”), including any digital products or physical goods sold through the site (the “store”). by using the app or site, you agree to these terms.

if you don’t agree, please don’t use the app or site.

## 1) who we are

“hexeosis,” “we,” “us,” and “our” refers to the owner/operator of the app and site.

## 2) what the app does (and doesn’t do)

the app provides timed breathing patterns and related visuals/sound/haptics.

the app is for relaxation and mindfulness. it is not medical advice, diagnosis, or treatment. if you have a medical condition or concerns about breathing exercises, please talk with a qualified professional.

## 3) eligibility + responsible use

you agree to use the app and site responsibly and lawfully.

please don’t:

- misuse the app/site in a way that could harm others or interfere with services

- attempt to reverse engineer, exploit, or disrupt the app/site

- use the app while doing anything that requires full attention (for example: driving)

## 4) premium features + purchases

the app may offer a one-time purchase to unlock premium features (“premium”).

### app store purchases

premium purchases made in the app are processed by the platform you downloaded it from (for example, apple app store or google play). your purchase, billing, refund, and subscription settings (if any) are managed by that platform and governed by their terms and policies.

if you believe you were charged incorrectly, or need a refund, please use the platform’s refund process first.

### restore purchases

if your platform supports it, you can restore purchases from within the app.

## 5) store purchases (hexeosis.com)

the store may offer digital downloads and/or physical goods.

unless required by law:

- digital goods are generally non-refundable once delivered

- physical goods are generally final sale, but if an item arrives damaged or is lost in transit, contact us and we’ll work with you to make it right

shipping times, customs fees, and delivery estimates can vary. any customs duties or import fees are the responsibility of the buyer.

## 6) intellectual property

the app, site, designs, artwork, text, audio, and other content are owned by us or licensed to us and are protected by applicable intellectual property laws.

you may not copy, modify, distribute, sell, or create derivative works from the app or site content unless we give you written permission.

## 7) user content

if you send us feedback, suggestions, or ideas, you agree we can use them without restriction or compensation (for example, to improve the app). we won’t claim you authored our product, but we may implement your idea.

## 8) third-party services

the app and site may rely on third-party services (for example: apple, google, squarespace, stripe). those services have their own terms and privacy practices, and your use of them may be governed by their terms.

we are not responsible for third-party services we don’t control.

## 9) disclaimers

the app and site are provided “as is” and “as available.” we make no warranties that the app/site will be uninterrupted, error-free, or perfectly secure.

## 10) limitation of liability

to the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the app or site.

## 11) changes

we may update these terms from time to time. if we make material changes, we’ll update the effective date above and post the updated terms here.
